Stopped while drunk on an e-scooter, what punishment can I expect?

Hello, I'm 19 and was stopped by the police about two weeks ago with a blood alcohol level of 1.6 per mille. I don't have a driver's license and have no criminal record.
What kind of punishment can I expect?

Hello? That’s a lot so when you get caught with 1.6 promille on the handlebar, you’ll get a crime known as a drunken ride. The penalty for this depends on various factors, such as whether you have caused an accident, have endangered others or whether you are a repeater. In the case of a drunkenness ride with 1.6 promille, you are threatened with a high fine or even a prison sentence. If you don’t have a driver’s license, you can threaten additional consequences. Driving without a driving licence can be punished with a fine or imprisonment of up to one year. You can also refuse to grant a licence for up to five years. It is important that you consult a lawyer to clarify your individual situation. And please never go under the influence of alcohol again! This is very dangerous for you and others!

the accusation “drive without a driving permit” is of course bullshit, escooter are vehicle-free. However, they count as motor vehicles with the alcohol limit values in force there

The e-scooter counts as a motor vehicle. With 1.6 per mille you have committed a crime, drunkenness drive according to § 316 StGB, the limit to absolute driving inability is 1.1 per mille

You’re expecting a criminal order over approx. 40 daily rates, a daily rate is a 30th of a net monthly income. In addition, the costs of blood collection are imposed on you. This is the criminal part, is a mass offence and is punished by a criminal order, a court trial does not take place. You can object to the criminal order, then it comes to the trial. If your income is too much appreciated, you can also raise an objection in isolation against the amount of daily rates, then this will be adjusted for proof.

A lawyer is only worthwhile in the case of existing legal protection insurance, which should also be directed, the concentration of blood alcohol is proven and the situation is clear.

You do not have to give any information on the matter in the course of the criminal proceedings

But now the administrative part still comes: there is a blocking period in which you cannot be granted a driving licence, you must not make a driving licence for the next 10-12 months. If you want to make a driver’s license later and make an application to the driving licence authority, this authority will ask you to provide a medical-psychological examination (MPU). In order to be able to pass these, you need to provide evidence of abstinence.

I really recommend the qualified forum http://www.transportportal.de/board/index.php?showforum=17 there you can sign your case again and get really competent help

Gerne.

Sure. I wouldn’t do anything. If the Criminal Order comes then check whether the amount of daily rates is appropriate and if necessary isolated (!) object to it, then 2 weeks after receiving time. If the number of daily rates is total, you also have 14 days to appeal, only then would I consider the inclusion of a lawyer. For the payment of the penalty, you can apply for a rate payment

in principle only the points are deleted when a driving permit is renewed

Irrelevant, because they are there for the first time and do not disappear after 30 months as with OWis. It’s just the questioned consequences.

Please don’t start here because the points are here first.

Also absolut unnütze Erbsenzählerei.

Why so aggressive? the points are given, but without any significance, since the questioner has no driving licence. And if he later requests a driving permit (to make the driving licence) and meets the conditions (end of the blocking period, MPU), the points are deleted when granting the driving permit. Point and end
