Best practice on eBay for replicas?

Hello folks 😉

I bought a low-value collector's figure from a private seller on eBay (10€). The seller described the figure as an original and expressly confirmed its originality to me via PM, otherwise I would not have bid.

What arrived was a fake figure/injection-molded replica.

The seller would take the figure back and refund the money, at least that's what he promised. Before the purchase, he insisted on insured shipping, but now he's insisting on a return shipment. :/

My problem now… if I return the figure and he claims he "didn't get anything," I have a problem with the shipment. If he gets the figure back and confirms it, he can tell any story he wants, and I have another problem.

My question!

Am I obligated to return the figure "before" the refund or can I expect/request a refund first?

You open a buyer protection case via eBay:

Click: eBay – Report problem with a seller

Then the pollutant Obligationto provide you with a free return label.

You send the article back and get your money back, very easy.

With me this has already gone well on the regular way over eBay and it was about much more money.

He can’t say that if you return with the return label you will get.

Even if he is a private seller and normally doesn’t have to take back, he promised me original and then actually sold a replica.

Right.

Forgery/replicates sell is not allowed on eBay also for private sellers.

This is also well known to me.

And for that reason you have Buyer protectionand you should use it:

You are obliged to send them back first.

I do so that I always do it with video and bring the package to the packing station (because I have my rest) and only close it in the final place (i.e. goods can still be seen). Then print a parcel note (ordered in advance by QR code) and then enter the packaging station.
