Construction is blocking my driveway. Who can I contact?
We live on a narrow one-way street in Munich's city center.
The house across the street has been under demolition for a year now, and plans are to redevelop it. Over the past few months, we've seen an increasing number of cranes and heavy-duty vehicles parked directly in front of our driveway for several days at a time, preventing us from using our vehicle or attending appointments.
We weren't given any warning. There was simply a no-parking sign posted for street parking.
Since I am self-employed and often have to drive in and out of my car, I have already suffered financial losses.
When I asked the site manager about it, he just smiled and told me not to make such a fuss.
The public order office also says that they are not responsible for this.
Who can I contact here?
Accessibility must be ensured by the owner of the building, as the construction is its project and thus its responsibility. Restrictions on the use of public transport routes must be disclosed to the construction authority in the building plan and announced prior to execution (blocking of the transport routes) and can also be enforced by the ordering authority subject to damages.
Of course, they are responsible for this, just like the police.
to the city administration
and then nix brings to the Mayor
You could ask at the road or civil engineering office whether they have a custody order.
If you don’t, the law office is in charge. However, it is necessary to make them understand that there is no criminal order.
If there is a custody order, they may.
Do I understand that they are allowed to park my driveway in serious cases so that I cannot use my parking space, which costs me over 100 € a month?
If they have an appropriate permit, they may even deny the whole road.
Hey, at the forum not Grölen 🙂 You can change the laws that are not right now. It’s just in politics.
I don’t know what the road looks like and whether the company has an appropriate permit at all, let alone whether there are any conditions in it and whether they are adhering to it.
In doubt there is something like “public interest” in Germany, where, for example, the creation of housing or job security is undermining. And then the public interest in the construction project quickly outweighs your personal interests in the private parking lot.
If those in the street would renew the asphalt ceiling or the waste water pipes, it can also happen quickly that you are no longer coming out of the entrance.
Bullshit. You can also find rules to not make life a hell for the residents. providing alternative parking space or at least an announcement would be a solution.
What are you doing? Without such rules, you could not build any more and then nothing is going on.
A high in Germany
Write a letter to the company, by registered letter, and ask them to release and hold your entry immediately. In case of non-compliance, you will announce that the costs for taxi rides etc. are to be charged by court. Best about a lawyer.
To the company itself.
I already called. Some of them were placed directly. Sometimes I was just smiled.
It’s just the move.
