Amazon is threatening to sue me?

Hello,

I ordered something for €800 and paid via SEPA direct debit. However, instead of the iPad I ordered, I received something completely different. Unfortunately, this seems to be a bit of a trend at Amazon these days.

Customer service had informed me in writing that I would receive a refund. However, two weeks later, I received an email informing me that the amount could not be refunded. This really shocked me, so I transferred the amount back to my account.

For about seven weeks, I've been receiving reminders every two days, which I throw away unopened. Can I sue Amazon for harassment? I've even offered to stop the reminders and take the matter directly to court, but I haven't received a response.

They're trying to put me under psychological pressure, even the parcel driver at Amazon rings the bell and demands that I sign what?

I would appreciate your help and advice on this situation.

But you've got a nice soup, and somehow I have a feeling that's missing in history. On what grounds did you refuse to return?

Either way, you can't just withdraw the money when it comes to disputes, break the contact and put the head in the sand.

It's clear that this isn't going well for you. You have entered into a contract and have failed to fulfill your obligations.

Either you're trying to settle this with Amazon personally and greedily as far as it's still going, or you're giving it to a lawyer. You don't have another choice.

Otherwise, the Amazon driver is no longer standing in front of the door. Or even the police, if Amazon considers this as a fraud. Not to mention the following costs.

You need a lawyer with that. If he no longer does, only a court can decide whether Amazon's claim is justified or not. And the court also decides whether you get your money back or not.

It is difficult to judge whether there is a criminal offense. And if there's a prosecutor, I doubt they're all overloaded.

You could go to a lawyer and try to make an omission statement. I think Amazon will not agree with this and then it will be in court. The process cost risk you would wear but if you win would definitely be over.

I would rather ignore all of them. Just be careful if there is actually a warning notice (yellow envelope) in any case make an objection and at the latest to the lawyer. But not to sign anything.

and control your shepherd. Claims that may not be disputed, but may of course be the Amazon which nevertheless reports as a delay in payment

whatever the threats, you can and may.

Immediately involve a lawyer, give him everything with evidence.
Then he will contact Amazon or the company that sold the article via Amazon.

Something went wrong here – and it is not necessary to suspect a bad intention (eg fraud). However, the issue will be resolved either legally or under the "threatening" of legal means out of court.

Since Amazon has no interest in image loss and fraud would not be their business model. Only Amazon can do nothing for the companies that do business on the marketplace.

Unfortunately, this is not an individual case at AMAZON.Further often false minor items are sent and you still insist on sending (the not received) articles back to the complaint.

Whether the articles are already exchanged at the warehouse or delivery is unclear – probably both…

And at AMAZON one hand doesn't know what the other does. Many customers give up annoyingly and pay because they are afraid of the “giants”.

I can hardly imagine that the Amazon customer service is not customer-friendly. It is only possible that a seller on the Amazon marketplace may act quite differently.

It is also conceivable that there can be a confusion with the business processes – and this then spreads on the back of the customers and can now land in court.

My case is done. I'm not the FS. And clearly, you should turn to a lawyer and inform consumer protection.

The problem is that AMAZON is a large foreign group. Legal steps can also become a fight David – Goliath.

You are allowed to inform consumer protection.

Non-functional processes where, in consequence, a trader as well as law firms still make a business without clarifying the subject with the customer or the customer cannot be accepted.

Even if such a single case does not interfere with a trader, a letter to the management is still useful. And with the public topicalization here on our platform, the topic would have an effect before.

By the way: the goods came directly from AMAZON, not from a dealer there. Otherwise, he would have been my contact and the cases I had searched for were all orders directly at AMAZON. I can only say, stay away from expensive purchases. Play the game with a 10 Euro article, then you can still see it away… Even though this is a huge business!

The problem is not customer service. For they say, send back the wrong article.

BUT: the problem is that the warehouse and the customer service apparently communicate zero. And the camp insists on the return of the article that was supposedly sent out. And the next problem is that the customer service is out. The business processes are in fact completely isolated! I had 5 different contacts in my case! No one wants to understand or can understand the problem. The last emails were also in such a bad German that I thought I was communicating with someone in Asia who was hired for such things.

So if you get BEFORE replacements to send the goods out, then the warehouse – or the Mahn department – asks you to return to the goods indefinitely. And you just think: well, I didn't get them, and that's why I'm complaining. But no one is interested.

After my research on the net (I was so angry and upset that I initially considered legal steps), I quickly noticed that I am not a single case.

I have read from people who have just paid because they shy the expensive process, from comparisons, but also from successful actions.

If I hadn't gotten from the complaint, who probably checked my customer account and found zero vulnerabilities over many years when I was a client, I would have lost 2000 EUR if I hadn't complained (with uncertain exit).

The usual blah "send the wrongly delivered article" doesn't bring you any further! Because the case is done for the complaint.

It is also well known, not only at AMAZON, that parcel drivers are sometimes long fingers or also warehouse employees. And of course, there are also fraudulent customers who only claim it. But if you're always complaining about expensive goods, they'll lock you up.

In my case, at least I deleted my account, PRIME canceled and will NEVER buy again. Interested in millions of customers worldwide but also not.

The rebooking was perhaps not the best idea, but in what I heard about similar cases at Amazon, it might not be the worst.

Nevertheless, I would strongly recommend you take a lawyer yourself.

And in the future, you don't order such valuable products at Amazon if they just get away and you're still supposed to sheet.

Amazon has become extremely customer-friendly in my opinion. The one people are erased accounts for which reason, others who would like to rate something more are required to order because they are only allowed to comment on so many orders, others are delivered the wrong goods even in articles in the 4 digit range and others (as you) are harassed or threatened by Amazon with judicial concessions…

I don't order Amazon anymore if there's the articles even where different. And see there: in other online shops there are the same products from the same companies and manufacturers often cheaper! For example, I would have to pay twice for a navel at amazon when I paid in the costume online shop. And that was exactly the same fool cap.

If you sent the wrong thing back, they have nothing to ask. And if you get your money back, it's your good thing, you've also resigned from the purchase as such. Let them crawl quietly, if they want something, they have to strike suits or the pavement way, the latter one does not have to fear.

Writing from the Enforcement Court have a nice form in it, since you simply cross in case of objection, do not have to specify any justification. Then the court itself is once again out of the matter as a civil-righteous thing. Now, Amazon would have to appeal. Are their home lawyers in their minds, but do they leave their fingers behind, because what are they complaining about? At the latest, the court itself would have to take the brake because no action is possible. And at worst, a clarification would be more in your sense. The money is your property, their incorrectly sent product they have back. There's nothing wrong. I would have acted the same as you, I have. They just don't like it when they get money back, they're getting poisonous, but it's banana what they like.

With regard to harassment, you can't do anything, anyone can ask as much he wants, paper is patient but your garbage bucket will certainly have enough space for it (but first read!). They will also be calmer. So you can relax completely, just what can happen now, but probably nothing more after a while.

I can understand Amz when that makes the round order the people iPhones and send back a bullshit. If they're running around, the method is unattractive.

Certainly there are also people who send false goods back with fraudulent intent. But in the net there are countless cases of people who got the wrong goods from AMAZON. This is not a single case!

Somehow this seems to be a scam by AMAZON :-(.

In any case, you're not alone. But you'll only receive generic emails, random emails from employees who don't understand the problem, and at some point, communication will cease entirely.

The problem: AMAZON ships an item. Whether it's replaced en route or mislabeled at the warehouse doesn't matter.

The customer receives the goods, opens the package, realizes it's the wrong one, and files a complaint. They return the goods as per the regulations, and then the drama begins!

Because the warehouse doesn't keep an inventory of these missing items and is independent of the complaints department. According to the system, you shipped item A and expect item A upon return. However, the customer never received item A. The warehouse can't do anything with the returned goods. You insist on item A and involve the legal department.

The claims department may understand the problem, but simply ignores it. Reminders, reminders, reminders come, and then the debt collection agency comes along.

In many cases, buyers give up in frustration and pay. Some file a lawsuit, and some are lucky, like me, that the employee in the complaints department understood and immediately sent out the correct item with a zero invoice after the complaint.

The wrong item: I was stuck with the postage costs, but it's bearable, even though the whole thing is a huge disgrace on AMAZON's part and looks very deliberate!

Conclusion: Amazon NEVER again!

If an item is mislabeled in the warehouse, or if delivery drivers (a common scam at Amazon too) swap high-quality goods for junk, then AMAZON simply doesn't understand the problem! And one department doesn't know what the other is doing either.

If the wrong item is delivered, a material defect always exists. This applies to both accidental and deliberate incorrect deliveries. Whether the delivered product has a higher or lower value than the item actually ordered is irrelevant. The only deciding factor for a material defect is that a different item than the one ordered was delivered.

That's the theory, but unfortunately not the practice at AMAZON. They insist that you return the item you supposedly received.

"I didn't receive my item," "The package was empty," "The item was already broken when I unpacked it" – these are all customer claims that online retailers have to deal with every day. Always pack and unpack high-quality items with two people. Take photos of the package and the incorrect item, and include them with your complaint. Refuse to accept damaged boxes from the courier!

If you complain about the wrong item, insist that they send you the correct item IMMEDIATELY. This will then be done with a zero invoice. If you then return the incorrectly delivered item (or not, since you'll be stuck with the costs anyway because AMAZON doesn't understand the problem), it doesn't matter if they remind you to return the item you never received. Because you have an invoice from them, and they're charging you. And rightly so, since you've received the correct item in the meantime.

Ultimately, you have to decide for yourself how to proceed. Either take legal action, pay for something you didn't get, or let it all come to that. Mind you, AMAZON has money and time, and another dissatisfied customer doesn't bother anyone anyway.

Insofar as you have revoked the purchase agreement in the intended period and have returned the product, Amazum cannot make/reach legally.

Print the email where Amazon writes to you that the amount will be refunded to you because of incorrect delivery and from to the lawyer. That's not going on!

The package driver probably cheated the package and now wants you to sign that you got the package so he doesn't have to pay it.
