Abrechnung mit Versicherung nach unverschuldetem Unfall korrekt?

Hallo Zusammen,

leider hatten wir in der Weihnachtszeit einen kleinen unverschuldeten Unfall. 

Wir waren beim Gutachter und haben nun die Abrechnung erhalten.

Ich wollte sicher gehen, ob so alles korrekt ist.

Wiederbeschaffungswert (Gutachten) 5500€

Restwert (wenn das Auto über die Versicherung verkauft wird) 2250€

Restwert (Gutachten)1655€

____________________________________

Fahrzeugschaden 3250€

Tatsächlicher Entschädigungsbetrag 3250€ + Gutachterkosten

Ich dachte eigentlich, dass der Wiederbeschaffungswert vom Gutachten (5500€) minus dem Restwert Gutachten (1655€) gerechnet wird, somit würde das 3845€ ergeben. 

Bin ich richtig, oder habe ich einen Denkfehler ?

Würde mich über hilfreiche Antworten freuen.

This billing is only conceivable when an economic total damage is present. Otherwise you’ll get the repair costs. If there is a total damage, it depends. You want to drive the car further: residual value withdrawal according to the opinion. You want to sell: Then the residual value is relevant according to the credits of the insurance. It has access to residual exchanges and you will then have to make the car available for sale as part of your damage reduction obligation. Or you still sell yourself at a lower price, then you just lost the difference. You should ask a lawyer who tells you exactly. Well, it’s always good if you have a legal protection insurance for that, then you can get paid to the lawyer and don’t have any stress.

It is also often considered inadmissible by the case-law that the reference to residual exchanges is also inadmissible. I say yes, lawyer is important if you don’t want to give money.

unfortunately we had a small one in the Christmas season indebted Accident…

You should ask a lawyer who tells you exactly. It’s always good if you have a legal protection insurance for that, then you can get paid by the lawyer and have no stress…

In a indebted accident the lawyer always pays the opponent’s insurance!

I actually thought that the repurchase value was calculated from the opinion (5500€) minus the residual value of the opinion (1655€), which would result in 3845€…

So repurchase would only be possible if the repair costs were > the repurchase value, i.e. a total damage would have occurred!

Residual valueif the car is sold through insurance) 2250€ Residual value (expected)1655€

So… No Insurance sells the possible scrap car at total damage, but residual value buyers come into action: the insurer only seeks the highest-end residual value buyers for you so that they have to pay as little as possible. You have to sell your junk yourself… is your car:-((

You’re right, the insurance won’t sell it yourself, much too elaborate. The whole thing is seen by consumers more as a trick to save money in regulation

In the opinion, there was certainly also something about the damage to the use of waste. In any case, even if the vehicle is repaired or a replacement vehicle is searched.

As a injured person, of course, you have the right to join a lawyer in case of disagreements in regulation.

Of course, they take off the higher residual value.

How high are the repair costs? Is the car really sold?
