A fixation is an extreme intervention in the patient’s fundamental rights and can therefore only be applied in the extreme emergency.

The basis is given if the patient is a serious danger to himself or others. And even then you have to differentiate. For example, a person who is restless and quickly falls out of bed would not be to fix the bed, but to prevent the fall with bed screens. But that would also be a liberty.

A fixation on the bed only comes into question when there is a massive risk, such as attack on personnel, removing vital accesses etc. The fixation can then be started to protect the body and life of the patient or other people, but must be immediately notified to the competent court. A judge must then approve the measure (or another suitable one).

A fixation must be terminated as soon as possible, even judicial decisions normally do not apply to eternal… In psychiatric clinics a different approach can apply. However, a judicial decision is always necessary for measures to be withdrawn.
