Leased vehicle with incorrect seat cover?

Hello everyone.
I ordered a new car about four months ago. It was supposed to have fabric seats. Today I received notification that my vehicle has arrived at the dealership, and I'm excited. The vehicle is a facelift model and has synthetic leather upholstery. My wife and I don't want leather at all, mainly because of the temperatures in the car, summer/winter.

What can I do now? I'll take a look at it, but I don't really want the car like this.

BGB and contract law. I’m not too stubborn, but I guess:

  1. If the originally ordered vehicle is no longer available, an equivalent vehicle must be delivered.
  2. If the alternative vehicle deviates significantly from the ordered, the buyer can withdraw from the contract.
  3. It is questionable whether a deviating seat reference represents an essential deviation.

Look what’s in the contract.

In most cases, the manufacturer has small changes in the context of facelifts/model year changes. Question is now just whether the difference fabric and leather is already “bigger”…

It’s not a question for a lawyer.

You ordered them with fabric seats, you don’t have to take them with artificial leather.
