Are there any special criteria that must be met regarding the termination of an FSJ contract by the FSD if the FSJ volunteer is still a minor?
Since the contract is not legally binding without the prior consent of the parents or guardians, to what extent must they be informed of the termination or even of the reasons for termination? (See also who must receive the termination notice, is there any special protection against dismissal, must the parents or guardians be informed of any misconduct, etc.)
I think you will not be able to clarify this question legally on GF, but you need support from the institution or possibly even by a specialist lawyer for labor law with experience in the field of volunteer services!
How to explain this assessment: I am an economist, working as a staff member with a supporter of youth assistance and have more than five years of experience with the topic of volunteer service from administrative and personnel perspective. Your question includes two to three special cases. The first is the voluntary service, which is not legally a working relationship, but which nevertheless applies to certain provisions of labor law. The second would be that in the case of voluntary services on the other side of the active person, there is not only an employer, but a place of employment and a carrier, i.e. three-page contracts. And the third special case is that you look out from a minor person!
The only thing I experienced in the five years was a resignation of a volunteer for repeated, innocent absence. This was already complicated enough, as we first had to whistle up with the wearer as a place of employment, who is pronouncing this termination and how the other's consent must be taken into account and documented. And here was at least the small advantage that my then employer did not fall under the law on termination! However, this volunteer was all year round. That would be the next aspect that would still play in here…
So if this is a specific case that affects you, contact the institution, the Federal Ministry or just a specialist lawyer to be able to examine exactly this, including the closed contracts! GF is really not a good platform for ;).
